The incumbent provides comprehensive legal counsel by reviewing legislation, drafting contracts, managing risk, representing the Authority in court, and aligning legal strategy with the government's digital transformation goals.

 

JOB PURPOSE:

The Director, Legal Services reports to the Chief Information Officer has responsibility for aligning the Division’s work programme with the strategic priorities of the Authority and ensuring that the legislative framework effectively supports the Authority’s mandate. The incumbent will be responsible for monitoring compliance with relevant laws and regulations, policies, standards and guidelines, representing the organization in legal proceedings, monitoring and managing all legal matters on behalf of the ICT Authority. The position will oversee the preparation and implementation of Contracts and Service-Level Agreements between the Authority and its clients and overseeing procedures to treat with breaches and non-compliance.

 

KEY RESPONSIBILITIES:

  • Leads the review of the Legislations and Regulations and other legal instruments and recommends amendments to ensure they remain relevant and effective.
  • Initiates drafting instructions and compiles information for submission to the Chief Parliamentary Council.
  • Provides quality legal advice to the CIO, Board of Directors, Heads of Divisions and Division Managers.
  • Provides legal advice on the interpretation and application of legislative provisions, Regulations and Orders, questions of law and legal opinions on other general legal issues.
  • Oversees the drafting of contracts and other legal documents in support of the Authority’s programme of work.
  • Develops and implements risk mitigation strategies for high-value contracts, identifying potential risks and implementing proactive measures to protect the organization’s interests.
  • Manages implementation of laws, regulations, rules, contracts, agreements and other legal instruments, sensitizing the respective teams on the interpretations.
  • Reviews all legal documents and contracts emanating from outside the Authority to determine their legal implications on the Authority; participates in and witnesses all contracts.
  • Advocates in the Courts of Jamaica by employing knowledge of the law, relevant documentation and examples of relevant case law in presenting arguments on behalf of the Authority.
  • Instructs external Counsel on the Authority’s position on all legal matters being represented.
  • Conducts relevant research to inform the Authority’s position on legal matters.
  • Leads the Division’s strategic planning process to ensure the achievement of the GoJ’s digital transformation business goals for the Sector.

 

REQUIREMENTS:

  • Bachelor of Laws (LLB), Certificate of Legal Education.
  • A minimum of eight (8) years’ experience in general legal practice, three (3) of which should be at a senior management level.
  • Practicing Attorney-at-Law at the Jamaican Bar.
  • Legal and regulatory knowledge is essential.
  • Knowledge of applicable legislation and regulations.
  • Knowledge of the information and communications technology sector would be an asset.
